This is the sequence a conveyancing file follows. Skipping any one of them is where buyers lose money in Kenya.

Official search
A search at the land registry showing the registered proprietor, the tenure and every encumbrance on the title. Nothing is signed before this is read.
- 02
Site visit and beacons
The plot on the ground is not always the plot on the map. A physical visit, and where necessary a surveyor, fixes the boundaries before money moves.
- 03
Rates and rent clearance
Land rates from the county and land rent from the national government must be cleared. An unpaid balance follows the land, not the seller.
- 04
Consents
Land Control Board consent for agricultural land, and any consent the lease itself requires. Without it, the transfer cannot be registered.
- 05
Spousal and family interests
Matrimonial property and family land carry rights that do not appear on the title. They still defeat a transfer.
- 06
Sale agreement
Deposit protection, completion date, what happens if either side fails, and who carries which cost. Written before the deposit, not after.
- 07
Stamp duty
Valuation by the government valuer, assessment, and payment. Duty is charged on the assessed value, not on the price you agreed.
- 08
Registration
Registration of the transfer and delivery of the title in the buyer's name. Possession without registration is not ownership.
