Dispute resolution

Settled at the table,
not won in the room.

Five of the firm's advocates are certified professional mediators. The firm's stated reason for existing is the amicable resolution of disputes; this is the practice that does it.

The qualification

Professional Mediation Certification

The 40-Hour Professional Mediation Training Course, offered by the Dialogue and Dispute Resolution Institute (DDRI) and completed between 31 August – 4 September 2026. Each certificate is signed by Prof. Kenneth Wyne Mutuma and carries the designation Certified Professional Mediator.

What mediation is

Mediation is a negotiation the parties control, held with someone trained to keep it moving. The mediator does not decide the matter and cannot impose a settlement — the parties do, or they do not, and the matter continues in court.

When it fits

  • The commercial relationship is worth more than the dispute.
  • The facts are not seriously contested, but the figure is.
  • A hearing date is a year away and the cost of waiting is the real loss.
  • The matter is sensitive and neither side wants it argued in open court.
  • The court has referred the matter to mediation.

Mediation is not right for every matter. It needs both sides at the table in good faith, and it does not suit a dispute that turns on a point of law needing a judgment, or one where a party needs an urgent order from a court. Where it does not fit, or where it is tried and fails, the firm runs the matter as litigation.

Bring it to the table first.

Tell us the matter and the deadline. If mediation is the wrong route, we will say so.
